Q: It is our practice to keep the application forms and interview notes of those job applicants who have been unsuccessful at interview. Do we have to obtain their signed consent to retain this information?

A: It is good practice for an employer to retain this documentation, in case an applicant makes a subject access request under data protection to see the information held on file by your organisation. You may also need to rely on this information if an applicant makes a claim for some type of discrimination, which allegedly occurred during the interview process.
