Q: Our company has outgrown our head office site and is looking to relocate to brand new premises approximately 10 miles away. We have communicated our proposal to staff and ensured that they have been aware of our plans from the outset. Please can you advise on the key aspects of law and best practice we need to be aware of in relation to the relocation and consultation with staff? We would also appreciate your ideas on how to manage the relocation project. Would we need to issue new contracts to staff if their place of work changes as they have no mobility clause? Would this constitute a change in terms and conditions and would we need to follow consultation procedures?
A: In the absence of a reasonable mobility clause, a major relocation is ultimately a redundancy situation because the work that the employees are employed to carry out, at that location, is expected to cease.
